Circular 1/2024 came out on 23rd January, 2024 on this matter as to Non-Resident in East Malaysia Regions. See below the Circular:
According to this circular, a Non-Resident of the Sabah and Sarawak Regions needs to obtain a valid work-permit in the respective immigration office, in order to practise Estate Agency in these two parts of Malaysia.
Furthermore, it is also mentioned that the Negotiators under them shall be "under his direct supervision", ie. the negotiators under this Registered Estate Agent shall be under his supervision in the location where he is operating a valid office. Thus, in the above Notification 1/2024, it is provided that "Negotiators residing and practising in real estate agency in Sabah/Sarawak shall only be attached to a Registered Firm registered locally in Sabah/Sarawak where:
a) a Resident Manager who is a resident and practising locally; or
b) when the Resident Manager is a non-resident of Sabah/Sarawak, he has to hold a valid work permit."
Obtaining a work permit for a non-resident in Sabah and Sarawak is under the immigration laws of each Region.
